Terms of Service

These terms govern your use of Use Brian, a shared team brain service operated by Delta Lab Limited ("we", "us", "our"). By using Use Brian at usebrian.ai or through connected messaging platforms, you agree to these terms.

1. The service

Use Brian is an AI-powered shared brain that remembers your team's conversations, customers, and context across sessions. It is available through a web interface and messaging platforms (Telegram, Slack). The assistant can connect to third-party services (Google Calendar, Gmail, Google Docs, Sheets & Slides, Notion, Slack, Threads, X) when you explicitly authorize it.

2. Accounts

You must be at least 13 years old and sign in with a Google account to use Use Brian. You are responsible for maintaining the security of your account. One person per account. Shared or automated accounts are not permitted.

3. Acceptable use

You agree not to:

• Use Use Brian to generate content that is illegal, harmful, or violates third-party rights.
• Use Use Brian to generate or publish content via the Threads connector that violates Meta's Community Standards or the Threads acceptable-use policy, nor content via any other third-party platform that violates that platform's terms.
• Attempt to extract, reverse-engineer, or probe the underlying AI models or system prompts.
• Use the service to send spam, phishing messages, or other unsolicited communications through connected services.
• Circumvent usage limits, rate limits, or access controls.
• Share your account credentials or access tokens with others.

We reserve the right to suspend or terminate accounts that violate these terms.

4. Plans and billing

Use Brian offers paid plans, with a free trial for new workspaces. Paid plans are billed monthly. Prices are listed on our pricing page and do not include applicable taxes. Usage limits apply per plan. When you exceed your limit, the model may downgrade one tier until your next billing cycle; the workspace owner may optionally purchase a one-time extra usage pack to raise the current cycle's limit. We never charge automatic or surprise overage fees.

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial billing periods.

5. Your data

You retain ownership of the content you provide to Use Brian. By using the service, you grant us a limited license to process your data as necessary to provide the service (e.g., sending messages to AI model providers, storing memories, executing actions through connected services).

6. AI-generated content

Use Brian uses third-party AI models to generate responses. AI outputs may be inaccurate, incomplete, or outdated. You are responsible for reviewing and verifying any information or actions the assistant provides. We are not liable for decisions made based on AI-generated content.

7. Connected services

When you connect third-party services (Google Calendar, Gmail, Google Docs, Sheets & Slides, Notion, Slack, Threads, X), Use Brian acts on your behalf within those services. You are responsible for the actions the assistant takes through your connected accounts. You can revoke access to any connected service at any time from your settings.

8. Availability and changes

We aim to keep Use Brian available and reliable, but we do not guarantee uninterrupted service. We may modify, suspend, or discontinue features with reasonable notice. We will not delete your stored data without notice except as required by law.

9. Limitation of liability

To the maximum extent permitted by law, Use Brian and Delta Lab Limited are provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Delta Lab Limited, its officers, and employees from any claims, damages, or expenses (including reasonable legal fees) arising from your use of Use Brian, your violation of these terms, or your violation of any third-party rights.

11. Dispute resolution

Before filing a formal claim, you agree to contact us at [email protected] to attempt to resolve the dispute informally. If we cannot resolve the dispute within 30 days, either party may pursue formal proceedings in the courts of Hong Kong SAR.

12. Changes to these terms

We may update these terms from time to time. Material changes will be communicated through the app. Continued use of Use Brian after changes take effect constitutes acceptance of the updated terms.

13. Governing law

These terms are governed by and construed in accordance with the laws of Hong Kong SAR, without regard to conflict of law principles.
